Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and the founders who operate Genga Anime List ("Genga", "the Operators", "we", "us"), the operators of the Genga Anime List website and services (the "Service"). Genga is currently an unincorporated project run by its founders; the Operators' legal identities are available on legitimate legal request. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and age requirement

You must be at least 13 years old to use the Service. If you are in the European Economic Area, the United Kingdom, or another jurisdiction that sets a higher minimum age for data-processing consent, you must be at least 16 years old (or the minimum age in your country). By using the Service you represent that you meet these requirements. The Service is not directed to children under 13, and we do not knowingly collect their personal data (see the Privacy Policy).

2. Your account

  • You are responsible for safeguarding your login credentials and for all activity under your account.
  • You must provide accurate information and keep it up to date.
  • You may sign in with email and password or with a third-party provider (Google, Discord). Your use of those providers is also governed by their terms.
  • Notify us promptly at genga.app@gmail.com if you suspect unauthorized use of your account.

3. User content

The Service lets you create and publish content, including reviews, ratings, comments, custom lists, your profile (display name, bio, avatar, and banner), and activity such as your library and follows ("User Content").

Ownership. You retain ownership of your User Content.

License to us. You grant Genga a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, display, adapt (for formatting and display), and distribute your User Content solely to operate, promote, and improve the Service. This license ends when you delete your User Content or account, except (a) for content others have shared or copied, and (b) for reasonable backup copies retained for a limited time.

Your responsibilities. You represent that you own or have the rights to your User Content and that it does not violate any law or these Terms. You are solely responsible for your User Content.

4. Acceptable use

You agree to follow our Community Guidelines. Among other things, you must not:

  • post content that is unlawful, infringing, harassing, hateful, threatening, or sexually exploitative of minors;
  • impersonate others or misrepresent your affiliation;
  • spam, scrape, or use bots to access the Service except as expressly permitted;
  • attempt to breach security, disrupt the Service, or circumvent rate limits or access controls;
  • upload malware or use the Service to violate the intellectual-property or privacy rights of others.

5. Moderation and termination

We may review, remove, or restrict User Content and may suspend or terminate accounts that violate these Terms or the Community Guidelines, at our reasonable discretion. Designated moderators and administrators may remove content and take enforcement action. You may stop using and delete your account at any time. We may discontinue the Service or any feature with reasonable notice where practicable.

6. Intellectual property and third-party content

The Service, including its design, software, and branding, is owned by Genga and its licensors and is protected by law. Anime metadata and cover images displayed in the Service are provided by AniList and remain the property of AniList and the respective rights holders; Genga does not claim ownership of that content. If you believe content on the Service infringes your copyright, see our DMCA / Copyright Policy.

7. Payments and subscriptions

The Service is currently free. If we introduce donations, paid features, or subscriptions, additional billing terms — including pricing, taxes, auto-renewal disclosures, and refund and cancellation rights (including any applicable EU right of withdrawal and California auto-renewal protections) — will be presented to you before purchase and will form part of these Terms. 8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that third-party data (such as AniList metadata) will be accurate or available.

9. Limitation of liability

To the fullest extent permitted by law, Genga and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 100. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Indemnification

You agree to indemnify and hold harmless Genga from claims, damages, and expenses arising out of your User Content, your use of the Service, or your violation of these Terms or any law.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by posting an updated date or notifying you in the Service). Your continued use after changes take effect constitutes acceptance.

12. Governing law and disputes

These Terms are governed by the laws of the State of Nevada, USA, without regard to conflict-of-laws rules. Subject to the arbitration agreement in Section 13, any dispute that proceeds in court will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to their jurisdiction — except where mandatory consumer-protection laws of your country of residence provide otherwise.

13. Binding arbitration and class-action waiver

Please read this section carefully — it affects your legal rights. It applies to the extent permitted by applicable law and does not override mandatory consumer-protection rights you may have under the laws of your country of residence (for example, in the EEA or UK).

Informal resolution first. Before starting an arbitration, you agree to email us at genga.app@gmail.com and give us 30 days to resolve the dispute informally.

Agreement to arbitrate. If we can't resolve it informally, you and the Operators agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, rather than in court, except as stated below. Arbitration is conducted by a neutral arbitrator and is more informal than a lawsuit.

Class-action and jury-trial waiver. To the fullest extent permitted by law, you and the Operators waive the right to a jury trial and agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding.

Carve-outs. Either party may (a) bring an individual claim in small-claims court if it qualifies, and (b) seek injunctive or equitable relief in court to protect intellectual-property or to address unauthorized access or misuse of the Service.

30-day opt-out. You may opt out of this Section 13 by emailing genga.app@gmail.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. If you opt out, the courts described in Section 12 will resolve disputes.

14. Assignment

The Operators may assign or transfer these Terms and their rights and obligations, and may transfer operation of the Service, in whole or in part — including to a successor entity such as a company the Operators may form (for example, a Nevada limited liability company) — without restriction or further notice. These Terms will bind and benefit any such successor. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
